1. General

Your use of the website is subject to these Terms, the Privacy Policy and the Information Use Policy & Disclaimer. If you do not agree to them, please do not use the website. The Hebrew version of these Terms is the binding version.

2. About the website

The website provides information about pregnancy and birth support, doula services, pelvic and uterine balancing treatments in pregnancy, birth story processing, postpartum support, courses, workshops and talks, as well as blog articles and videos.

The website is not an online store. Services are arranged and purchased directly with the Business Owner, by phone, WhatsApp, email or in person.

3. Not medical advice

The content on this website is for general information and enrichment only. It is not a diagnosis, medical advice or a substitute for consulting a physician, midwife or other qualified healthcare professional. See the Information Use Policy & Disclaimer.

4. Booking and payment

• Before any transaction you will receive the details of the service: its price, timing, payment terms and cancellation terms.
• Prices are in Israeli shekels (ILS). Prices may change from time to time, but a change will not apply to a transaction that has already been agreed.
• Payment can be made by Bit, credit card, bank transfer or another agreed method. A receipt or tax invoice is issued for every payment.

5. Cancellation and refunds

Cancellations follow the Israeli Consumer Protection Law, 5741-1981, and the Consumer Protection (Cancellation of Transaction) Regulations, 5771-2010. Among other things:

• Distance transactions (by phone, online, WhatsApp, etc.): you may cancel from the date of the transaction until 14 days from that date or from receipt of the document with the transaction details, whichever is later. For a service, cancellation must be made at least 2 days, excluding rest days, before the service begins.
• Cancellation fee: unless the cancellation is due to a defect or non-conformity, a fee of 5% of the price or ILS 100, whichever is lower, may be charged. If the service has already started, a proportional payment for the part already provided will also be charged.
• Senior citizens (65+), persons with disabilities and new immigrants (up to 5 years from receiving status) may cancel a distance transaction that included a conversation with the Business Owner within 4 months, under the conditions set by law.
• Cancellation is subject to the exceptions set out in the law and regulations.
• You can give notice of cancellation by email, WhatsApp, phone, or in writing to the business address.
• Refunds are made within 14 days of receiving the cancellation notice, using the original payment method.
• If the Business Owner cancels a service or workshop, the full amount paid for the part not provided will be refunded.

6. Marketing messages

Marketing messages, such as newsletters, promotions and offers, are sent only with your explicit consent, in accordance with section 30A of the Israeli Communications (Telecommunications and Broadcasting) Law, 5742-1982. Submitting the contact form or the medical questionnaire does not count as consent to receive marketing.

You can withdraw consent at any time by using the unsubscribe link, by replying “remove”, or by contacting us by email or phone.

7. Use of the website

• Please provide accurate and complete details in forms, and only your own details or details you are authorized to provide.
• Do not post offensive, misleading, infringing or unlawful content, including in blog comments. The Business Owner may remove such content.
• Do not take any action that may harm the proper operation or security of the website.

8. Intellectual property

All rights in the website’s content belong to Emma Li Hemed Shmila or to the respective rights holders. This includes texts, articles, photos, videos, design, marks and names, including “Emma The Doula” and FEMMA. Content may not be copied, reproduced, distributed, published or used commercially without prior written consent. Sharing a link to a page is permitted.

9. Third-party links and content

The website includes links to, and embedded content from, third parties such as YouTube, Instagram, Facebook, WhatsApp and the FEMMA website. Their use is subject to those parties’ own terms and privacy policies. The Business Owner is not responsible for their content.

10. Liability

The website and its content are provided “as is”. The Business Owner works to keep the website available and accurate, but does not guarantee uninterrupted or error-free operation. To the extent permitted by law, the Business Owner will not be liable for damage caused by technical failures beyond her control, or by relying on general information on the website instead of consulting a qualified professional. Nothing in these Terms limits your rights under applicable law.

12. Changes

These Terms may be updated from time to time. The version published on the website at the time of use applies. A change will not apply to a transaction already made.

13. Governing law and jurisdiction

These Terms and the use of the website are governed solely by the laws of the State of Israel. The competent courts in Israel have jurisdiction over any dispute.
